Rules
1. Eligibility
To be considered eligible for the Contest, the individual submitting the application for the Contest (the “Representative”) must meet the following conditions at the time of registration and throughout the duration of the Contest:
a. Must be at least 18 years of age;
b. Must be a resident of Canada;
c. Must accept cookies.
2. How to participate
To participate, eligible individuals must register for the Contest, purchase required, by proceeding as follows:
2.1. Registration
To participate, simply share a photo of your Tero on Facebook or Instagram with #MyTero and tagging @teroinnovation or share your experience by leaving a review at teroinnovation.ca/reviews.
2.2 Limit
A limit of one application per Representative is allowed. The information of the participants will be transmitted to the database and will become the property of the Organization..
3. Duration of the contest
The “Share and Win” contest (the “Contest”) is run by Tero (the “Organizer”).
3.1. Registration Period
The “Share and Win” contest will start on Wednesday, June 1, 2022, at 9:00 a.m. and will end on January 31, 2023, at 11:59 p.m. EST.
3.2 Prize
Of all the eligible entries received, only one (1) will be drawn at random on Monday, February 6, 2023, at 10:00 a.m. in Quebec City.
The winner will be awarded 5 years of anti-odour filter refills valued at $500 + tx (the “Prize”).
The Prize does not contain any other fees and items other than those mentioned in the prize description above. In addition, the Prize is not replaceable or refundable in the event of loss, theft, or damage.
The Prize shall be accepted as awarded and shall not be transferred, in whole or in part, to another person, exchanged for another Prize or for money.
3.3 Award
In order to be declared a winner, any selected Representative will have to:
3.3.1. Have been reached by telephone or email by the Organizer. In the event that a selected participant is reached by email, he or she shall respond to the email in accordance with the instructions provided therein, if applicable. In the event of a prize notification email followed by a statement that the message could not be delivered, the Contest Organizer has the sole discretion to disqualify the participant’s entry or attempt to contact the participant by telephone:
3.3.2. Complete and sign all forms or documents requested by the Organizer and return it to the Organizer by email, scanned, within 48 hours of receipt;
3.3.3. Upon request and in a timely manner, provide identification with a photograph.
3.3.4. If the Organizer or its representatives are unable to contact a selected participant in a draw within 48 hours of the draw after taking reasonable steps, if a selected participant fails to return any forms or information requested within the time limit, refuses to accept the prize or in any way violates these Rules or fails to comply with the Rules, that person will be disqualified and the Organizer will proceed to award the prize until a winner is identified or, at their discretion, may forfeit the prize(s).
4. Prize Delivery
An order will be placed on the Organizer’s online store on behalf of the Representative. The Prize will be delivered to the address provided by the Winner. The Winner will be notified by email when his or her prize is ready for shipment.
5. Miscellaneous provisions
5.1. Organizer Rights
The Contest Organizers reserve the right, in its sole and absolute discretion, to modify, without prior notice, the Contest schedule or any of the dates indicated in these Contest Rules, when necessary, in order to verify the compliance of any participant or entry with these Contest Rules, or due to technical problems or any other circumstance that, in the opinion of the Contest Organizers and at its sole discretion, may affect the proper administration of the Contest in accordance with these Contest Rules, or for any other reason.
5.2 Applicant Obligations
Applicants must provide all the information and documents requested within the required timeframe. By submitting their application, the participants consent to the use of their name and photo for advertising purposes without financial compensation.The participants undertake not to exercise any action against anyone because of a few decisions or actions taken by the company Tero in the context of the Contest. By entering the Contest, any winning person shall authorize, if required, the Organizer or its partners to use his or her name, photograph, image, place of residence, voice and/or statements relating to his or her prize for advertising purposes without any form of remuneration. By entering the Contest, any winning person shall authorize, if required, the Organizer to disclose his or her personal information to its partners for the purpose of executing the Contest, including the presentation of prizes, if any.
5.3 Other
5.3.1 Incomplete, illegible, fraudulent, late, invalid, or otherwise non-compliant entries will be rejected and will not be eligible for the prize.
5.3.2. The Organizer, its partners and the contest entities expressly disclaim any and all responsibility and/or liability for injury, damage or loss of any kind, to the property or persons resulting from the receipt and/or subsequent use of the prize awarded. By entering the contest, each participant agrees that: (1) to the extent permitted by applicable law, the participant knowingly and expressly waives any and all remedies for punitive, direct, indirect, exemplary, consequential or special damages, loss of profits, and waives any right to multiply or increase such damages, and that (2) any and all disputes, claims and causes of action arising out of or in connection with this Contest or any prize shall be resolved individually, and without resort to any form of class action.
5.3.3. The winner selected for a prize acknowledges that upon the award of the prize, the obligations associated with the prize become the responsibility of the supplier of services and products that comprise the prize. The Organizer shall not be liable for any problems or incidents that may arise as a result of the award or use of the Prize.
5.3.4. The Organizer does not guarantee in any way that the Contest website will be accessible or functional without interruption during the Contest period, or that it will be free of errors.
5.3.5. The Organizer assumes no responsibility for the improper functioning of the Contest website, any computer component, software, network, or communication line, for the loss or absence of network communication, or for any transmission or communication that is faulty, incomplete, incomprehensible, or erased by any computer or network and that may limit or prevent any person from participating in the Contest.
5.3.6. The Organizer assumes no responsibility for any damage or loss that may be caused directly or indirectly, in whole or in part, by the downloading of software or forms from the Contest website and by the transmission of information in connection with the Contest.
5.3.7. The Contest is subject to all applicable federal, provincial, and municipal laws.
5.3.8. The Organizer reserves the right to disqualify a person or to cancel the registration (or entries where applicable) of a person if he or she participates in or attempts to enter this Contest using a means which violates these Rules or which is of a nature that is unfair to the other participants (e.g., registrations beyond the permitted limit or multiple registrations using false identities). This person could be turned over to the appropriate judicial authorities.
5.3.9. Any attempt to sabotage the legitimate conduct of the Contest constitutes a violation of civil and criminal law. If such attempts are made, the Organizer reserves the right to reject the participant’s entries and obtain compensation under the law.
5.3.10. In the event that the computer system is unable to register all Contest entries during the Contest Period for any reason, or if participation in the Contest is terminated in whole or in part prior to the end date set out in these rules, draws may be made, at the discretion of the Organizer, from the entries that have been duly registered during the Contest Period or, if applicable, up to the date of the event that terminated the Contest.
5.3.11. In any case, the Organizer may not be required to award more prizes or to award a prize other than in accordance with these Rules.
5.3.12. No communication or correspondence will be entered into with participants in connection with this contest other than in accordance with these Rules or at the Organizer’s initiative. Personal information collected about participants in this Contest will only be used for the administration of this Contest. No communication, commercial or otherwise, unrelated to this Contest will be sent to the participant, unless he or she has otherwise consented.
5.3.13. The Entries and Forms are the property of the Organizer and will not be returned to the participants under any circumstances.
5.3.14. If any paragraph of these Rules is declared illegal, unenforceable, or invalid by a court of law, then that paragraph shall be deemed invalid, but all other paragraphs that are not affected shall be enforced to the extent permitted by law.
5.3.15. In the event of a discrepancy between the French version and the English version of these Rules, if such a version exists, the French version shall prevail.
5.3.16. All decisions of the Contest Organizer or of its representatives regarding this contest are final and without appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec, in relation to any matter within its jurisdiction.
6. Régie des alcools, des courses et des jeux
6.1. Subject to the approval of the Régie des alcools, des courses et des jeux du Québec if required, the Organizer reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Contest in whole or in part in the event of an event or human intervention that corrupts or affects the administration, security, fairness, or normal operation of the Contest.
6.2 Any dispute regarding the organization or conduct of a promotional contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any dispute regarding the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux du Québec only for the purpose of attempting to resolve it.
